Dark Passage (subtitled Al Jolson in His First Hollywood Film) is a 1941 American film, an adaptation of the play by Robert Merritt and John Parker about the first dark passage from London to New York for a black singer named Stanley Jefferson, played by Al Jolson. The film stars Jolson and Helen Hayes.

Al Jolson is a black Italian opera singer with a big hit record. He meets English girl Grace, and she is interested in him, and the two live together. Grace takes a singing job in New York, where she sings some big hits and becomes a star.

Meanwhile, Stanley Jefferson is a young black guy who lived for a long time with his parents in New Jersey. When his mother gets sick, he decides to go to New York to find a job, but he ends up in jail after getting into a fight. He gets out, and a taxi driver says that he can make more money as a cab driver, and he runs away from home. When the taxi driver lets Stanley stay in his house, he really gets into trouble. Stanley then goes to work for a hooker, and meets a girl named Pat, who is his cousin. He tells her about Grace.

Gradually, Stanley finds out that Grace has become a big star, and he finally can reunite with her, which allows Grace to bring her whole family with her to the states. It’s fun for Stanley, as Grace likes his singing, and he finally feels good about his life.

On appeal, the New Mexico Court of Appeals held that such a failure to object was not fatal, so long as the trial court was provided a fair opportunity to rule on the objection. Hines, 120 N.M. at 638, 905 P.2d at 908.
However, in the present case, there was no objection to the exhibit. The statement made by defense counsel during the testimony of Detective White was sufficient to preserve an objection for appeal. The only mention of the exhibit during Detective White’s direct examination was the following:
